As always, the topic of Deed Restrictions
brings much discussion at the Board Meetings. Often, the discussions are heated as there are varying opinions about
which Deed Restrictions to enforce as well as how to enforce them. These discussions are not new, and in fact many of the
issues we struggle with are easily answered. Regarding the "which ones" question, the answer is very simple:
the ones outlined very specifically in the Deed Restrictions documented for this community. The current Board did not
invent these restrictions, they have been in existence since this community was built. Sounds simple, yet there is persistent
debate over whether we should enforce restrictions.
It is important to understand that we, as individuals, do not
get to choose which Deed Restrictions we want enforced. To the contrary, when each of us moved into Eniswood, we said
"I want to live in this neighborhood and I accept the conditions of doing so". Very simple, very legal and
your Homeowners Association Board is committed to protecting everyone’s collective interests. A few suggestions have
been made to help us with this process.
First, we have established a committee to oversee all violations
and enforcement protocols. This will be a big help as it has been pointed out enforcement has not been as thorough as
possible. Rest assured this will change, and please recognize we have made tremendous strides toward effective and equitable
enforcement. We have a proven history of improvement and we will continue to enhance our processes until we have achieved
compliance as required by law. Second, we will no longer be making personal visits to violator's homes. This practice
was initially recommended by the Board but it has in fact turned out to be too personal. Enforcement of Deed Restrictions
is not personal; it is perhaps the single most important fiduciary responsibility of the Board. Finally, there are three additional
committee members who will be canvassing our neighborhood and reporting infractions. In the past, purely for practical
purposes, we have relied on complaints from residents. It will be most beneficial to have these committee members participating
in this area.
